甲方根据《中华人民共和国广告法》及其他有关法律规定,聘请乙方艺员（以下简称：艺员），为甲方“********”
产品担任平面代言人，用于本合同约定时间内为该产品拍摄“休闲服”产品系列之宣传广告。乙方及艺员接受聘请，甲乙双方为此合作达成如下一致意见：
一、甲方同意付乙方人民币（）（下文称“酬金”），乙方同意参加本合同规定项下的所有演出服务。
二、酬金支付方式及时间安排：
1、酬金以现金方式支付。
2、酬金为税后净款，甲方负责缴纳乙方在本广告内所收取酬金的一切税款。
3、本合同签订当日内付总酬金的30%，即人民币肆拾叁万叁仟伍佰元整（Rmb：元）。
4、广告首次拍摄工作日前十日内付总酬金的40%，即人民币伍拾柒万捌仟元整（Rmb元）。甲方于首次广告拍摄前三日内付总酬金的30%，即人民币肆拾叁万叁仟伍佰元整（Rmb：元）。
5、甲方在支付乙方第三期酬金的同时应将全部酬金的完税单据一并交给乙方，
6、甲方未能按本合同约定支付酬金，或完全交付酬金的完税单据，乙方及艺员有权拒绝参加广告拍摄工作。同时，本合同无须通知即自动终止。乙方及艺员按本合同规定的未完成义务也无需继续履行。乙方已经收取的酬金不予退回。
三、为完成拍摄工作甲方应当承担的其他费用
1、艺员需离开北京或其他工作地到外地拍摄时，甲方需提供及支付艺员及乙方有关工作人员演出期间的机票、膳宿及交通费用。具体标准如下：
（1）、机票：提供乙方艺员、经纪人头等舱往返机票；乙方两名助理及化妆师、发型师四人经济舱往返机票；或往返至北京或乙方艺员工作地的最佳交通工具。
（2）、酒店：提供艺员行政套房一间；提供乙方工作人员标准房五间（与艺员同一酒店），并负责一切膳食及当地豪华房车租用费用。甲方为乙方预定的酒店应征得乙方的认可。
2、艺员指定的化妆师、发型师及广告美术指导的服装造型费和服装材料费。具体标准为：化妆师每天人民币壹万元整，发型师每天人民币壹万元整，服装费用为人民币壹万元整。所有款项要在工作开始前付清。工作时间超过壹天的以当时通知价格为准。
3、乙方艺员在拍摄广告期间，患病、受到意外伤害所需的医疗费以及人身意外伤害保险费（保险额为人民币叁佰万元）。
四、艺员需提供如下各项演出服务：
如甲方需要艺员参加影视拍摄次数，在乙方及艺员同意的情况下，则甲方须每次另付艺员酬金人民币万元整（的其他待遇和费用按本合同相关规定办理。待遇与费用涉及的款
项在拍摄当天工作前一次性付清。拍摄影视广告每次不超过一个工作天，每天不超过十小时，不足十小时亦作一天计算。工作时间从中午12：00开始。此工作天数不包含艺员从其他工作地到达广告拍摄地的差旅时间或住地到拍摄地的时间，但包含
拍摄前期的准备工作（如化妆、发型、服装造型等）。

如甲方在协议期间需要艺员参加多于甲方所规定的平
面拍摄次数一次，在乙方及艺员同意的情况下，每次需另付艺员酬金人民币万元整（Rmb万元整），酬金应在工作前三天付清。艺员的工作时间和乙方随行人员待遇新增活动的其他待遇和费用按合同相关规定力理。待遇和费用所涉款项在拍摄当天工作前一次性付清。
3、公关活动：
共***次，每次一个工作天，每天活动自开始至结束，时间不超过二小时，不足二小时亦作一天计算。乙方需带化妆师、发型师,其劳务费由甲方承担。所有乙方随行人员的交通、住宿由甲方承担。各类人员的住宿及交通的标准按本合同第三条执行。公关活动时间安排，甲方应提前与乙方联络商谈。公关活动的形式和内容由甲乙双方协调确定，但最后以乙方书面同意的日期、内容和形式为准。公关活动的工作时间并不包含艺员的差旅时间，但包括化妆、发型时间。
如甲方需要艺员参加公关活动多于上述规定次数，在乙方及艺员同意的情况下，甲方须在活动前三日一次性另付艺员酬金人民币万元整（Rmb：万元整）。艺员工作时间及乙方随行人员新增活动的待遇和费用按本合同相关规定办理。应支付给随行人员的待遇和费用在活动当天工作前一次性付清。
4、有关一切拍摄工作的日期、地点，如遇特殊情况需作更改的，双方应当协商确定。协商确定后，按新计划执行。
5、如果平面广告或影视广告需要重新补拍时，甲方需提前两个月向乙方提出申请，乙方将根据艺员档期与甲方确定拍摄时间，酬金另议。
